Just when the Chinese solar industry is starting to gain some traction the scandals that crushed investor confidence in Chinese stocks are back again. An SEC charge of securities violations against accounting firms Deloitte, KPMG, PricewaterhouseCoopers, BDO, and Ernst & Young is now in court and "Client A" in exhibits yesterday turns out to be none other than Canadian Solar (NASDAQ: CSIQ  ) , one of the largest solar manufacturers in the world. �

Canadian Solar disclosed an SEC subpoena requesting documents in 2010 but it's been virtually forgotten about by most investors amid the industry's turmoil since then. But last night, when the investigation surfaced again and it was revealed that accounting firms had blocked giving documents to the SEC, the stock fell 5% after hours.

The core contention in court this week is over what the Chinese branches of these accounting firms can release to U.S. investigators. The accounting firms who represented Canadian Solar are saying China's secrecy laws prohibit them from disclosing some documents, which makes it tough to investigate fraud. So, it's hard to know whether the SEC's investigation into Canadian Solar would have led to anything or not because the commission was stonewalled in its efforts.

In the dividend ETF arena, most funds tend to focus on maximizing yield.     When dividend stocks get too popular, their prices get out of line with both their dividend income and the fundamentals of the businesses that underlie those stocks. In simpler terms, when dividend stocks become bad values, it's time to consider looking elsewhere for a margin of safety.

    Another under-$10 stock that's starting to trend within range of triggering a big breakout trade is Penn West Petroleum (PWE), which is engaged in the business of acquiring, exploring, developing, exploiting and holding interests in petroleum and natural gas properties and related assets. This stock has been under pressure by the bears during the last three months, with shares off by 24%.

    If you take a look at the chart for Penn West Petroleum, you'll notice that this stock has been trending sideways over the last two months, with shares moving between $7.89 on the downside and $8.84 on the upside. Shares of PWE are now starting to spike higher above its recent low of $8.14 a share and it's quickly moving within range of triggering a breakout trade above the upper-end of its recent sideways trading chart pattern.

    Market players should now look for long-biased trades in PWE if it manages to break out above some near-term overhead resistance levels at $8.84 a share to its 50-day moving average of $8.96 a share with high volume. Look for a sustained move or close above those levels with volume that hits near or above its three-month average action of 2.43 million shares. If that breakout hits soon, then PWE will set up to re-test or possibly take out its next major overhead resistance levels at its 200-day moving average of $10.07 to $11 a share. Any high-volume move above those levels will then give PWE a chance to tag $11.50 to $12 a share.

    Traders can look to buy PWE off any weakness to anticipate that breakout and simply use a stop that sits right below some key near-term support levels at $8.14 a share or at $7.89 a share. One can also buy PWE off strength once it starts to clear those breakout levels with volume and then simply use a stop that sits a comfortable percentage from your entry point.

James Bullard, president of the Federal Reserve Bank of St. Louis, said that the outlook for the U.S. economy is "quite good," despite data from early in the year. "The biggest thing is that unemployment has come down more quickly than expected," said Bullard, speaking on a panel at the annual Credit Suisse (CS) investor conference in Hong Kong. He added later during a question and answer session that more progress is needed in the labor market before U.S. policymakers can consider raising interest rates. Bullard is known to be one of the Fed's more hawkish policymakers. He previously advocated for a rate hike as early as 2014, a stance he appears to have backed away from. U.S. monetary policy tightening took center stage last week after a two-day policy meeting, when the Fed said it expected to keep benchmark interest rates near zero for a "considerable time" after it wrapped up a bond-buying stimulus program, which it is widely expected to do toward the end of the year. Pressed on the statement at a news conference afterward, Fed Chairman Janet Yellen said the phrase "probably means something on the order of around six months or that type of thing." Stocks and bonds immediately tumbled as traders took the statement to suggest rate hikes could come sooner than they had anticipated. Bullard has joined other Fed officials in playing down the "six months" comment from Yellen, saying it was in line with what the private sector was anticipating. He repeated that view Wednesday. Four months after negotiating a financial lifeline from Goldman Sachs (NYSE: GS  ) and Credit Suisse (NYSE: CS  ) -- bankers who, if you ask me, would be just as happy to see Alcatel fail and forfeit its patent portfolio -- the company's just piling more debt atop an already top-heavy debt load.
